Texas court recognizes same-sex common law marriage

capitol-buildingflagAUSTIN – A Travis County woman has won her long battle to be acknowledged as her deceased partner’s legal spouse, marking the first time in Texas a same-sex common-law marriage has been recognized in a court ruling.

Attorney General Ken Paxton is mulling whether to challenge the marriage’s legality, however, a move the woman’s lawyer calls unnecessary, illegal and offensive.

“This is just part of his continuing disregard for the most fundamental concepts of American jurisprudence,” Brian Thompson, the attorney for surviving partner Sonemaly Phrasavath, said of Paxton, a staunchly conservative Republican and a vocal opponent of same-sex marriage. “The state of Texas, and in particular Ken Paxton, would have absolutely no interest in this case if it were one of the thousands of cases in Texas, thousands of heirship proceedings, except for the fact that it’s a same-sex couple, and that’s discrimination.”

Meanwhile, gay rights activists are hoping the ruling draws attention among same-sex couples to their common-law marriage options.
